The Company Fiskars Brands UK, publisher of the Fiskarettes Blog, which can be accessed by going to http://www.fiskarettes.co.uk/ is implementing the “Fiskarettes Design Team”, hereafter the Design Team, in order to increase members’ involvement in the life of the Fiskarettes Blog. These rules aim to set out the conditions according to which the members of the Fiskarettes Design Team will be appointed, as well as their role within said Design Team.These rules may under no circumstances be applied to matters that do not concern the Fiskarettes Design Team. They are applied in parallel with the Conditions of Use, which are accepted by Fiskarettes members to which they may refer.

ARTICLE 1: Presentation of the Fiskarettes Design Team

The Fiskarettes Design Team, meaning “creation team”, is made up of different Fiskarettes members who very actively participate in the blog. The Design Team is a tight knit team, requiring its members’ involvement in making and putting articles (projects, products, tricks and tips…) online with the aim of sharing their passion for creative leisure pursuits. In exchange for receiving Fiskars products, Fiskarettes Design Team members are asked to respect the different undertakings, mentioned below (paragraph 4) in order to ensure the main mission of the Design Team within the Fiskarettes Blog (post personal creations using Fiskars products) and become the ambassadors of the blog among Fiskarettes members and third parties.

The Design Team will consist of three 3 members selected by a Jury made up of Fiskarettes members who have submitted their candidacy in accordance with the conditions stipulated below. The team shall be renewed every three months in order to vary the articles and to allow as large a number of Fiskarettes as possible to belong to the team. All candidates applying to become a member of a Design Team acknowledge having submitted their candidature voluntarily and freely. Under no circumstances shall such person request any financial compensation in return for their participation as a member of the Fiskarettes Design Team.

ARTICLE 2: Conditions of Participation

2.1. Becoming a member of the Fiskarettes Design Team is open to all persons who meet the following cumulative conditions:

• being a member of the Fiskarettes Blog,
• being an active member, that is having posted (a minimum of 2) articles and (a minimum of 10) comments on the blog,
• having stood as a candidate to become a member of the Design team according to the conditions stipulated below
• not being a member of a rival Design Team on the date of registration and throughout the “mandate”of the Fiskarettes Design Team member. In case of doubt, please inform us as to the DT to which you belong.

Within the means available, respect for these criteria shall be verified. Failure to meet one of the criteria shall mean that the candidature is not accepted and therefore not evaluated by the Jury.

Besides, it shall be understood that candidature for the Fiskarettes Design Team is not authorised for any members of staff of the company Fiskars or their family members (partner and children), including common law husbands/wives and, generally speaking, anybody who is directly involved in the elaboration of the Fiskarettes Design Team, its composition, and its running.

2.2. The submission of your candidature to become a member of the Fiskarettes Design Team is performed exclusively online in accordance with the following conditions:

• Access the Fiskarettes Blog and log in as a member of Fiskarettes,
• Access the form posted to submit your candidature to become a member of the Design team for the registration period, as stated on the Blog,
• Fill in the form, serving as your letter of candidacy to become one of the members of the Design team, including your identity, making mention of the items posted on the Fiskarettes Blog, of your creative preferences (card sketch, scrapbooking, home decor, bijouterie….), the address of your blog if you have one and finally your reasons for becoming a member,
• Accept these rules, without reservation, and especially article 4 concerning the undertakings of Design team members,
• Validate your registration prior to the end of the registration period.

In this context, we would stipulate that:

• Each registration period shall be open for a period of three (3) weeks, whose dates shall be published on the Blog,
• As a Design Team is appointed for three (3) months, a new registration period shall be opened around two (2) months after a team has been appointed,

2.3. It is left completely up to the candidates to decide as to the contents of their candidature and especially their reasons in order to convince the jury as to their candidature and become an appointed member. In any case, in accordance with the Conditions of Use of the Fiskarettes Blog, all candidates are forbidden from including data unrelated to them, incorrect data or out-of-date data.

Otherwise, their candidature may not be accepted.

2.4. Each candidature shall be confirmed upon completing the registration procedure by the posting of a message online. Please note that all registrations thus validated may not subsequently be withdrawn by a candidate.

Failure to respect any of the aforementioned conditions will lead to the disqualification of the candidature by the Jury.

ARTICLE 3: Appointing the members of Fiskarettes Design Team

3.1. Appointing the members of Fiskarettes Design Team

A jury shall appoint the 3 members who will make up the Design Team for 3 months, from among the Fiskarettes members who have submitted their candidature. The Jury shall dispose of one (1) week in order to deliberate at the end of the three (3) weeks of registration in order to appoint Fiskarettes Design Team. The Jury shall be comprised of different members of the company Fiskars Brands, Blog publisher, and of the ambassadors of the Fiskarettes Blog. In this context, we would point out that the members of the Jury will base themselves especially on the following items when taking their decision, though this list is not all inclusive:

• the quality and diversity of the creations made by the candidate
• the member’s activity on the Fiskarettes Blog
• the candidate’s speciality (card sketch, scrapbooking, home decor, bijouterie…), in order to appoint members of the Design team with different specialities.

The Jury is committed to act as impartially as possible in appointing the different members of the Fiskarettes Design Team, and to ensure appointing members who are able to fulfil their role as fully as possible.

3.2. Information concerning appointed members

Each candidate chosen by the jury to become a member of Fiskarettes Design Team shall be informed by email from the Fiskarettes Blog ambassadors. Said candidate is committed to keeping their appointment to the Fiskarettes Design Team confidential in all publications posted on the Fiskarettes Blog. Upon receipt of this email, the appointed member shall submit to the Fiskarettes Blog ambassadors an article in which he or she shall introduce him or herself as well as state his or her motivation, which will then be published on the Fiskarettes Blog. In this context, the ambassadors may require that the members should include some complementary information, notably via a list of questions. The member request that only their nickname be published and not their name(s) or surname(s) Failure to send this article of presentation within the required deadline shall mean that the ambassadors shall make said presentation in place and on behalf of the member concerned regarding the information conveyed for the purposes of their candidature. If a candidate appointed a member were to wish to withdraw, application to do so must be made within the 24h following the receipt of the above mentioned email. Said candidate shall then be substituted by another candidate by means of an exceptional selection process carried out by the Jury.

ARTICLE 4: Status of the Fiskarettes Design Team

4.1. A Design Team is appointed for 3 months. During this period, its members shall be committed to carrying out their mission as stipulated below, and to respecting the conditions outlined below. The members of the Design team will enjoy privileged contact with the ambassadors of the Fiskarettes Blog in order to perform their mission, and shall carry out the latter in return for no financial compensation. All failure to respect these conditions, or any condition stipulated in the Conditions of Use of the Fiskarettes Blog, may lead to the replacement of the non-compliant member, by a candidate who was not initially chosen, following an exceptional decision taken by the Jury.

In this regard, any item or material received by the member of the Fiskarettes Design Team shall be returned by the latter at their expense.

4.2. From the time a Fiskarettes Design Team has been formed under the conditions outlined above, Fiskars Brands shall send to each of the 3 members of the team some Fiskars products so as to be able to make articles (projects, products, tricks and tips…). Under no circumstances may a member of the Fiskarettes Design Team request financial compensation in place of the aforementioned Fiskars products.

Each member of the Fiskarettes Design Team is asked, therefore, to

a) perform at least 2 creations per month, each member of Fiskarettes Design Team being free to choose their creation.

However, they are asked to abide by the following criteria:

• to use all of the products sent to each member within the 3 months and the use of at least 3 such products in the creation made,
• to respect the themes provided by the ambassadors of the Fiskarettes Blog when applicable.

The members of the Fiskarettes Design Team are committed to making their creations themselves and shall not copy or reproduce any creation made by a third party without their authorisation.

For each creation made by each of the members of the Fiskarettes Design Team, they shall:

• take photographs of their creation,
• publish said photographs on the Fiskarettes Blog, with written step-by-step explanations as to how their creation was made,
• if possible, once within the three months, make a video which will be published on the Fiskarettes Blog in place of the publication of a photograph and written explanations.

Fiskars may also ask each of the members of Fiskarettes Design Team to physically send them their creation in order to photograph it, and in turn the members may ask Fiskars to return their creations to them. The means of sending the creation shall be determined by Fiskars and members shall be duly informed thereto.

Expenses incurred by members on such occasion shall be reimbursed upon request to Fiskars with the shipment of the necessary pieces when applicable.

b) to convey their opinions and advice concerning the use of these products.

They may publish their opinions in the way they wish, it being understood that all publications must be made in accordance with the rules of use of the Blog, especially abstaining from mentioning any illegal unconstructive content, (unfounded opinions, slander …).

The members of the Fiskarettes Design Team in their capacity as ambassadors of the Blog, shall also be asked to take part in the promotion of the Fiskarettes Blog and of Fiskars products during the 3 months of their appointment.

It is left to the discretion of the members to choose the means of carrying out said promotion. To this end, members may contact the ambassadors in order to gain advice and recommendations as to how to perform the promotion optimally.

4.3. By default, each of the members of Fiskarettes Design Team also has the general mission of strengthening their involvement in the Fiskarettes Blog.

To this end, each member of the team shall be committed to being active and available by replying in as short a time as possible to any questions, postings or comments published on the Fiskarettes Blog concerning their creation.

In exchange, members of the Fiskarettes Design Team are given the chance to:

- include a Fiskarettes Design Team banner on their personal Blog

- publish the creation they have made in their role as a member of the Design team on their personal blog, once it has been published on the Fiskarettes Blog.

4.4. Each of the members of the Fiskarettes Design Team accepts to cede all rights attached to each of the creations made within the guidelines of their mission, as well as those attached to the photographs, videos and explanatory written texts published on the Blog concerning the aforementioned creations.

In this context, each of the members of Fiskarettes Design Team shall cede the rights to the reproduction, representation, adaptation and exploitation attached to all creations made during their mission to Fiskars. Such cession is consented by each of the members of the Fiskarettes Design Team, free of charge for the legal duration of the protection of rights world wide, for whichever use, whether for commercial purposes or not, on any and every medium.

Fiskars is committed to mentioning, with regard to the use of the creations thus ceded, the identity of the member of the Fiskarettes Design Team who made the creation, barring express renunciation by the latter.

Likewise, each member of Fiskarettes Design Team shall authorise Fiskars to use, without compensation, any photograph, video in which the member appears on any medium and by any means for any promotion of Fiskars products, and promotion of the Fiskarettes Blog.

The members of the Fiskarettes Design Team shall keep Fiskars indemnified for this purpose against all claims, demands and legal action for counterfeiting, and shall make it their business to obtain any and all necessary authorisation from third parties, when applicable, to be faithful to their commitment to Fiskars.

ARTICLE 5: Data of a personal nature

The Personal data policy that appears in the Conditions of Use is also applied to these rules governing the Fiskarettes Design Team.

The data collected in the context of setting up the Fiskarettes Design Team shall under no circumstances be used for any other purpose than for the appointment of the Design Team, and those purposes set out in the Conditions of Use. In this scope, all information conveyed when submitting candidatures shall be used exclusively for the purposes of ensuring the appointment of the different Design Teams. Consequently, such information shall be erased upon completion of the deliberations by the Jury appointing the Fiskarettes Design Team.

As mentioned, in the Conditions of Use, each member of the Fiskarettes Design Team and each candidate may request the communication of, access to, the modification and erasure of data concerning them, by contacting Fiskars either in writing, or by email to custserv@fiskars.co.uk, or by post to the headquarters of Fiskars Brands UK.

ARTICLE 6: General points

The company Fiskars shall not be held liable in the terms of the present contract for matters beyond those foreseen in the Conditions of Use of the Fiskarettes Blog.

These rules are governed by British law.

All interpretations, contestations and claims concerning these rules as well as the running of the Fiskarettes Design Team shall be settled by applying French law.
